When are you eligible to file for Bankruptcy Protection for the second time?   The 2-4-6-8 Rule in a nutshell.

2: After 2 Years you can file for a Chapter 13 Bankruptcy if you previously filed a Chapter 13 Bankruptcy and were discharged.

4: After 4 Years you can file for a Chapter 7 Bankruptcy if you previously filed a Chapter 13 Bankruptcy and were discharged.

6: After 6 Years you can file for a Chapter 7 Bankruptcy if you previously filed a Chapter 13 Bankruptcy and were discharged.

There is an exception to this rule if you paid back your creditors in full – 100% in your prior Chapter 13 Plan or if the Court finds that you had acted in good faith and paid your creditors at least 70% back in your prior Chapter 13 Plan then the 6 Year Rule will not apply to you.

8: After 8 Years you can file for a Chapter 7 Bankruptcy if you previously filed a Chapter 7 Bankruptcy and were discharged.
